1. Acceptance of Terms

By accessing and using the Old Vehicles Marketplace website, mobile application, or any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (the "Customer" or "Buyer") and Old Vehicles Marketplace (the "Company," "we," "us," or "our").

If you do not agree with any part of these terms, you must not use our services or make any purchases through our platform. Your continued use of our services after any modifications to these terms constitutes your acceptance of the updated terms.

These terms apply to all visitors, users, customers, and others who access or use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website. It is your responsibility to review these terms periodically for changes.

2. Definitions

For the purposes of these Terms and Conditions:

  • "Platform" refers to our website, mobile application, and all related services.
  • "Vehicle" means any pre-owned automobile, motorcycle, truck, or other motor vehicle listed on our platform.
  • "Order" means your request to purchase a vehicle through our platform.
  • "COD" means Cash on Delivery payment method.
  • "Delivery" means the physical transfer of the vehicle to the specified delivery address.
  • "Inspection Period" means the 24-hour period after delivery during which you can inspect the vehicle.
  • "Quality Check" means our comprehensive 150-point vehicle inspection process.

3. Vehicle Purchase Process

3.1 Eligibility

To purchase a vehicle through our platform, you must be at least 18 years of age and possess a valid government-issued identification document. You must also have the legal capacity to enter into binding contracts under applicable law. By placing an order, you represent and warrant that you meet these eligibility requirements.

3.2 Vehicle Information

All vehicle information displayed on our platform, including specifications, condition reports, and images, is provided based on our inspection and the information available to us. While we strive for accuracy, we recommend that customers conduct their own inspection during the inspection period. Vehicle availability is subject to change without notice.

3.3 Order Process

Our order process involves seven sequential steps designed to ensure transparency and customer satisfaction. You must complete all required steps before your order is confirmed. Once you confirm your order, it becomes binding, and the vehicle is reserved for you pending delivery and payment.

3.4 Order Confirmation

Upon completing the order process, you will receive an order confirmation with a unique tracking number. This confirmation does not guarantee vehicle availability but indicates that your order has been received and is being processed. We will contact you within 24 hours to confirm availability and delivery arrangements.

4. Pricing and Payment

4.1 Pricing

All prices displayed on our platform are in Indian Rupees (INR) and include all applicable taxes unless otherwise specified. Prices are subject to change without notice, but the price quoted at the time of order confirmation will be honored. The final price includes the vehicle cost, delivery charges (if applicable), and any additional services selected.

4.2 Cash on Delivery (COD)

We primarily operate on a Cash on Delivery (COD) model to ensure customer confidence and transaction security. Payment is due at the time of vehicle delivery and inspection. We accept cash payments in Indian Rupees only. The delivery executive will provide a receipt upon payment completion.

4.3 Payment Security

Our COD model ensures that you only pay after receiving and inspecting your vehicle. This eliminates the risk of advance payment frauds and gives you complete control over the transaction. However, the COD amount must be exact, as our delivery partners may not be able to provide change for large denominations.

4.4 Additional Charges

While delivery is free across India, additional charges may apply for remote locations, expedited delivery, or special handling requirements. Any such charges will be clearly communicated and agreed upon before order confirmation. We do not charge any hidden fees or surprise costs.

5. Delivery Terms

5.1 Delivery Coverage

We provide free delivery services across India, covering 25 states and over 500 cities. Delivery timelines vary based on your location and vehicle availability. Typical delivery times range from 3-10 business days for major cities and 7-15 business days for remote locations.

5.2 Delivery Process

Our trained delivery personnel will contact you 24 hours before delivery to schedule a convenient time. You or your authorized representative must be present to receive the vehicle. Valid identification is required for vehicle handover. The delivery process includes vehicle inspection, documentation transfer, and payment collection.

5.3 Delivery Address

Vehicles can be delivered to your home, office, or any accessible location within our delivery coverage area. The delivery address must be accurately provided during the order process. Changes to delivery address may result in additional charges and delivery delays.

5.4 Failed Delivery

If delivery fails due to customer unavailability or incorrect address information, we will attempt redelivery. Additional delivery attempts may incur charges. If multiple delivery attempts fail, the order may be cancelled, and any applicable charges will be communicated to the customer.

6. Vehicle Inspection

6.1 Pre-Delivery Inspection

Every vehicle undergoes our comprehensive 150-point quality check before delivery. This inspection covers engine performance, body condition, interior state, electrical systems, safety features, and overall functionality. A detailed inspection report is provided with each vehicle.

6.2 Customer Inspection Period

Upon delivery, you have 24 hours to thoroughly inspect the vehicle and verify that it matches the description and condition report provided. During this period, you can test drive the vehicle, check all features, and ensure satisfaction with your purchase.

6.3 Inspection Guidelines

During inspection, please check all mechanical systems, electrical components, body condition, interior features, documentation, and accessories. Any discrepancies should be reported immediately. The vehicle should be inspected in adequate lighting conditions, preferably during daylight hours.

6.4 Acceptance

If no issues are reported within the 24-hour inspection period, the vehicle is considered accepted in its delivered condition. After this period, claims regarding vehicle condition that could have been identified during initial inspection may not be entertained.

7. Warranty and Support

7.1 Limited Warranty

We provide a limited warranty covering major mechanical systems for a specified period from delivery date. Warranty terms vary by vehicle age, type, and condition. Detailed warranty information is provided with each vehicle and forms part of your purchase agreement.

7.2 Warranty Coverage

Our warranty typically covers engine, transmission, braking system, and steering components. It does not cover normal wear and tear, consumables, cosmetic issues, or damage caused by misuse, accidents, or lack of proper maintenance. Warranty claims must be processed through our authorized service network.

7.3 Post-Sale Support

We provide comprehensive post-sale support including maintenance guidance, service center recommendations, insurance assistance, and technical support. Our customer service team is available during business hours to address any questions or concerns regarding your vehicle.

7.4 Service Network

We have partnerships with authorized service centers across India to provide warranty service and maintenance support. Service costs for non-warranty repairs are borne by the customer. We recommend using our network for optimal service quality and genuine parts availability.

8. Returns and Cancellation

8.1 Return Policy

Due to the nature of vehicle transactions, returns are generally not accepted after the 24-hour inspection period. However, if the vehicle significantly differs from our quality report or has undisclosed major issues, we will consider return requests on a case-by-case basis.

8.2 Cancellation Before Delivery

Orders can be cancelled before vehicle dispatch without penalty. Once the vehicle is dispatched for delivery, cancellation may incur logistics charges. Cancellation requests must be made through our customer service team and will be processed within 24 hours.

8.3 Return Conditions

If a return is approved, the vehicle must be returned in the same condition as delivered, with all documentation and accessories. Return shipping costs may be borne by the customer unless the return is due to our error or misrepresentation.

8.4 Refund Process

Approved refunds will be processed within 7-10 business days of vehicle return. Refunds are provided through the same payment method used for the original transaction. Processing fees, if applicable, may be deducted from the refund amount.

9. Limitation of Liability

9.1 Disclaimer

While we strive to provide accurate information and quality vehicles, we cannot guarantee that all information is completely accurate or that vehicles will meet your specific expectations. Our liability is limited to the purchase price of the vehicle and direct damages only.

9.2 Limitation of Damages

Our total liability for any claims related to vehicle purchase shall not exceed the amount paid for the vehicle. We are not liable for indirect, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or emotional distress.

9.3 Third-Party Services

We work with third-party service providers for delivery, logistics, and other services. While we select these partners carefully, we are not responsible for their actions or omissions. Any issues with third-party services should be addressed directly with the respective service provider.

10. Data Privacy

10.1 Information Collection

We collect personal information necessary for processing your vehicle purchase, including contact details, identification documents, and payment information. This information is used solely for transaction processing and customer service purposes.

10.2 Data Protection

We implement appropriate security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Your data is stored securely and accessed only by authorized personnel for legitimate business purposes.

10.3 Information Sharing

We do not sell, trade, or rent your personal information to third parties. Information may be shared with service partners only as necessary to complete your transaction, such as delivery partners for vehicle shipment or payment processors for transaction handling.

11. Dispute Resolution

11.1 Customer Service

We encourage customers to first contact our customer service team to resolve any disputes or concerns. Our team is trained to handle various issues and will work towards a fair resolution. Most disputes can be resolved through direct communication.

11.2 Mediation

If direct resolution is not possible, disputes may be referred to mediation through a mutually agreed mediator. Mediation costs will be shared equally between the parties. Both parties agree to participate in good faith in the mediation process.

11.3 Arbitration

If mediation fails, disputes will be resolved through binding arbitration under the Arbitration and Conciliation Act, 2015. The arbitration will be conducted in Mumbai, Maharashtra, and the decision of the arbitrator will be final and binding on both parties.

12. Governing Law

12.1 Applicable Law

These Terms and Conditions are governed by the laws of India. Any legal proceedings arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

12.2 Consumer Protection

Nothing in these terms shall exclude or limit consumer rights under applicable consumer protection laws. In case of conflict between these terms and consumer protection laws, the consumer protection laws will prevail.

12.3 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. The invalid provision will be deemed modified to the extent necessary to make it valid and enforceable.
